Welcome to Boutique Americana Mystery Scoops. These Terms of Service ("Terms") govern your use of our website and your purchase of products and services from Boutique Americana Mystery Scoops ("Boutique Americana," "we," "us," or "our").

By accessing our website, placing an order, or purchasing our products or services, you agree to these Terms, our Return & Refund Policy, Privacy Policy, Shipping Policy, and any other policies posted on our website.

Please read these Terms carefully before making a purchase.

1. Mystery Product Experience

Boutique Americana offers mystery-style shopping experiences, including but not limited to Mystery Scoops, Freedom Capsules, True Mystery Boxes, and other surprise products or promotions.

By purchasing a mystery product, you acknowledge and agree that:

  • The specific contents of your purchase are intentionally unknown at the time of purchase.

  • Product selection may involve random or semi-random selection methods.

  • Specific products, colors, patterns, styles, brands, categories, or designs are not guaranteed unless expressly stated otherwise.

  • Photographs, videos, social media posts, previous customer orders, and promotional materials are examples only and do not guarantee that you will receive the same products.

  • Mystery assortments may vary from customer to customer and order to order.

  • Receiving an item that does not match your personal preference does not mean the product is defective or that the order was fulfilled incorrectly.

The mystery and variation of products are fundamental features of the Boutique Americana shopping experience.

2. Mystery Scoop Process

Our Mystery Scoops use beads or other designated markers to determine or represent prizes, prize categories, special selections, or other components of an order.

The beads themselves are part of our selection process and are not included with the customer's order unless specifically stated otherwise.

By purchasing a Mystery Scoop, you understand and accept the selection process described on our website at the time of purchase.

3. Freedom Capsules

Freedom Capsules contain or represent additional mystery selections and may include an individual product, bundled products, or other specially selected surprises.

Specific Freedom Capsule contents and retail values may vary.

Additional Freedom Capsules may be purchased subject to the limits displayed on our website. Unless otherwise stated, customers may purchase a maximum of three (3) Additional Freedom Capsules per order.

Attempting to circumvent purchase limits through multiple transactions may result in cancellation of the affected orders.

4. True Mystery Boxes

True Mystery Boxes contain a preselected assortment of products that remain unknown to the customer until the box is opened.

Contents may vary between boxes. No specific item, category, color, design, brand, or assortment is guaranteed unless expressly stated in the product listing.

Limited-quantity promotions are available only while supplies last.

5. Product Value

Any stated or advertised retail value, estimated value, or value range is provided in good faith based on information reasonably available to Boutique Americana at the time the product is prepared or listed.

Retail prices may vary between retailers, locations, sales events, manufacturers, and over time.

An estimated retail value does not represent a cash value and does not guarantee that a customer could personally sell or purchase an item for that amount.

6. Product Availability & Substitutions

Because Boutique Americana may carry limited quantities, seasonal merchandise, specialty products, and changing inventory, individual products may become unavailable.

When necessary, we may substitute a reasonably comparable item while maintaining the overall nature of the purchased mystery experience.

7. Returns, Refunds & Final Sale Products

Mystery Scoops, Freedom Capsules, True Mystery Boxes, and other designated mystery products are final sale, except where an item arrives damaged or defective, Boutique Americana makes an order fulfillment error, or otherwise required by applicable law.

Personal preference is not considered a product defect.

8. Video Scoop Reveals

Customers may have the option to purchase a Mini Video Scoop Reveal or Full Video Scoop Reveal.

Video reveal services are personalized services associated with an individual customer's order.

Once production of a purchased video reveal has begun, the video service is non-refundable except where Boutique Americana is unable to provide the purchased service.

By purchasing a video reveal, you authorize Boutique Americana to record the selection and/or reveal of your order.

We will not intentionally display sensitive payment information in a video.

9. Pricing & Payment

All prices are displayed in U.S. dollars unless otherwise stated.

Prices, promotions, product availability, and special offers may change without notice.

You agree to provide current, complete, and accurate billing, payment, shipping, and account information when making a purchase.

Applicable taxes and shipping charges will be calculated or disclosed during checkout when required.

10. Order Acceptance

Submitting an order does not necessarily constitute final acceptance of the order.

Boutique Americana reserves the right to refuse or cancel an order when reasonably necessary, including in cases involving:

  • Suspected fraud or unauthorized transactions

  • Pricing or listing errors

  • Inventory errors

  • Attempts to circumvent product limits

  • Abusive or threatening conduct

  • Orders that cannot reasonably be fulfilled

If we cancel an order after payment has been collected and before fulfillment, the applicable canceled amount will be refunded.

11. Shipping

Customers are responsible for providing a complete and accurate shipping address.

Boutique Americana is not responsible for delays caused by shipping carriers, severe weather, service interruptions, or other circumstances outside our reasonable control.

Customers should contact us promptly regarding packages that arrive damaged or orders that appear to have shipping-related problems.

12. Chargebacks & Payment Disputes

If you believe there is a problem with an order, we encourage you to contact Boutique Americana first so we have an opportunity to investigate and resolve the issue.

Initiating a chargeback does not automatically override these Terms, our Return & Refund Policy, or the terms agreed to when the order was placed.

We reserve the right to provide order records, tracking information, customer communications, applicable policies, video or fulfillment records, and other relevant documentation to payment processors or financial institutions when responding to payment disputes.

Nothing in this section limits any lawful rights you may have regarding unauthorized transactions or legitimate billing disputes.

13. Promotions & Discount Codes

Promotions, discounts, giveaways, and special offers may have separate eligibility requirements, expiration dates, quantity limits, or other restrictions.

Unless expressly stated otherwise, promotions cannot be combined.

Boutique Americana reserves the right to cancel or modify a promotion in the event of an error, misuse, fraud, or circumstances reasonably outside our control, subject to applicable law.

14. Gift Cards

Gift cards may be used toward eligible purchases through Boutique Americana.

Gift cards are not redeemable for cash except where required by law.

Lost, stolen, or improperly used gift cards may be subject to limitations permitted by applicable law.

15. Intellectual Property

The Boutique Americana Mystery Scoops name, branding, original graphics, photographs, product descriptions, videos, website content, logos, designs, and other original materials are owned by or licensed to Boutique Americana and may be protected by applicable intellectual property laws.

You may not reproduce, distribute, sell, modify, or commercially use our protected content without permission.

16. Acceptable Use

You agree not to use our website or services to engage in fraudulent, unlawful, abusive, malicious, or otherwise prohibited activity.

You may not interfere with the operation or security of our website or attempt to gain unauthorized access to systems, customer information, accounts, or services.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Boutique Americana will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our website or purchase of our products.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

18. Disclaimer of Warranties

Except as expressly provided by Boutique Americana or required by law, products and services are provided on an "as available" basis.

Nothing in these Terms limits warranties or consumer protections that cannot lawfully be waived.
